Property

please advise how the partition would be for my family scenario as mentioned below.

my father has two wifes. 1st wife has 2 childs and i m only one child to my mom.we are living in same house more than 25 yeas and all the names are available in ration card. now my dad died. property details: 3acres(in my father name - grandfather asset), 2acres- my father own asset..

now there s problem in my family, 1st wife son said there s no rights for second wife and her name will nt be there in legalesor certificate but they included my name.

yes he is absolutely right.contracting a second marriage while the first marriage is subsisting makes the second marriage illegal but the issues arising out of such marriage is legitimate.thats why your mothers name is not included whereas your name is there in lh certificate

Your right is intact in your grandfather's property despite the fact you are born out of an illegal marriage,

You have a share in the ancestral property as well as in your father's self earned property, whereas, your mother has a share in your father's self earned property.
