Procedure to apply for Mutual Consent Divorce

Learned Lawyers, 

Background: Wife living seperately for last 3 years. No understanding between us to continue family life. Marriage has irretreivably broken down. Wife working in her hometown, have a 4 year old daughter in her care. Both of us have arrived at a consensus to mutually seperate. However, they are yet to place their demands. Understanding that she does not want to continue in this marriage, father in law planning to extract maximum compensation in negotiations.

Please could you advice me as under

1. What is the procedure for Mutual Consent Divorce ? Any any learned member provide me a draft copy of a Mutual Consent Divorce petition (in word file format ?).

2. When already the seperation is for more than a continous period of 2 years, can the 6 month cool of period be waived off ?

3. What safeguards should I take when it comes to negotiating settlement money ?

4. What precations should I take when I pay settlement money ( keeping in mind she can backtrack on her commitment and not present herself in court for 2nd motion, or withdraw from the petition of mutual consent).

5. Can the court appoint a mediator / arbitrator ?

6. How do I ensure that my child gets the benifit of settlement money and my in-laws dont directly benefit with the settlement money they have received. This is because the lumpsum money might be used for their other family needs without directly benefiting the child.

7. How do I ensure that I continue to get visitation / unrestricted visitation to the child or even custody at a later stage. How do I put thses clause in the final settlement. What should I do in case they do not allow me visit the child in the future and they back-track on conditions.

8. How to ensure that she will not drag me or anybody else from my family to court in a false dowry harrasment case after the settlement is reached ?

Would it be a better option to instead file RCR in court (since wife is not interested in continuing relationship) and try to win RCR and then file divorce for wife not complying with RCR. Should I try and fight the case on merits (since I have made sincere efforts for reconciliation).

Will settlement amount or alimony prescribed by court be less in this case, though I know this will take atleast 3 years of my life.

You will have to file a petition u/s 13(b) of the Hindu Marriage act.  There will be a conciliation stage in the divorce proceedings.  The judge may ask you regarding for the cash settlement if your wife demands for that, if you are ready to pay the money then it should be mentioned in the order sheet and she must undertake that she will not claim any future maintenance.  Everything should come in the compromise petition.  You can also request the court to keep the money in Fixed Deposits in the name of the your children.

Before going for the compromise it is better to settle all these matters befrore the elders and same should be noted in the ordersheet.

It is NOT a good idea to file RCR. Once you file RCR there is every possiblity that you wife will say the she wants to come back. and there is no gaurantee that you will win. RCR will take atleast 2 years and Divorce will take at least 2 years So 4 years of your life will be gone.

And even after you made sincere efforst for re-conciliation and you have merits in your case there is no gaurantee that you will win in the first O.P itself. There is a chance that you may get Divorce in The Appeal in the High Court/Supreme Court because the District Court ( Family Court ) Judges are not inclined to give Divorce that easily even though they see merits in  the case.

So its better to go for Mutual Consent of Divorce but make sure that you get things settled out in Minimum possible compensation having you elders and your side Lawyers in the settlement Proceedings.

Mutual consent divorce is a process by which martial status of a married couple comes to an end. This is one of a way to get divorce and most easiest form compared to other forms like Divorce by DesertioncrueltyAdultery etc. This mode of divorce is normally called uncontested form of divorce and is envisaged in Section 13B(1) and 13B(2) of Hindu Marraige Act 1955. This form is commonly known as first motion and second motion divorce petition both petitions separated by 6 months period.

Here are some of the requirements of getting divorce by mutual consent

  1. Mutual consent

As the name suggest Mutual consent divorce first requirement is that there must be a mutual consent between the couples. That means all issues between them like custody of children, maintenance, alimony have been resolved between them and only they intend is to get a divorce only. There is also a separation period between the couple of not less than one year. the divorce by mutual consent

How to come to a mutual consent

The husband and wife sit together either with the help of close relatives, lawyers or in mediation. They first decide custody and visitation rights of children and their custody normally custody of children goes and decided mutually in favor of wife and husband do get visitation rights if this is decided then they proceed ahead with issues related to maintenance and alimony to wife. Normally husband agree on lump sum and one time  payment of fixed amount in favor of wife and wife on the other hand will not demand any maintenance or alimony in future. only when all the above issues are resolved the mutual consent divorce is possible.

2. Preparation of Mutual consent divorce agreement

After oral discussion its now time to get it on paper here at this stage mutual consent agreement is prepared and which is a detailed documents of whatever has been agreed between the couples they are bound by it. the mutual consent agreement has to be notarized and signed in front of notary public.

3.  List of documents for mutual consent Divorce

  1. Petition of mutual consent divorce both motions along with waiver of 6 months cooling off application in case you wish to waive off 6 months waiting period between two motions. if other spouse is in other country then power of attorney of other spouse.
  2. 4-5 recent photographs to be pasted on petition and agreement.
  3. Proof of marriage which includes either Marriage card with marriage photographs or marriage registration certificate with marriage photographs.
  4.  Id card with address proof

Note: you must carry originals at time of court hearing.

4. Court Hearings

At the time of court hearing you must reach on time and all originals must be carried by you at the time of hearing. Once your matter name is called you must be ready to answer questions put up be judge.

  1. Common questions like date of marriage and separation?
  2. custody of children?
  3. Consent is without any coercion or undue influence?

After basic questions the couple move ahead for verification of original document and hearing is concluded once they sigh on their respective statements.

Conclusion of Mutual consent divorce Proceedings

After the conclusion of both first and second motion court hearings the court will prepare a decree of divorce which is a formal document of divorce and officially couples are separated by decree of divorce and process is concluded.
