Hi all !!

 My grandfather made an agreement(return deed) ( REGISTERED)which was bound with 5years term time , that the mortgage(XYZ) will give him the house paper back when he or his son will return the taken amount by mortgage. But after few months of the agreement grandfather died. Now, the mortgage transferred the agreement to the 3rd party by taking signature of my father on unregistered paper by saying that he has taken the permission (consent) of the heirs . As that permission was unregistered ,will it still be valid?

 It's a premateur sale as the mortgage didn't wait for the whole 5 years. The agreement was with my grandfather.

Not valid.  You can give notice to the concerned third party.  Agreement is not a negotiable instrument.
