Around 3 year back i start construction of my shops. After 2 months contractor ran away by taking excess money. Now after three years I again start constructing those shop then he threaten us so i submit an application in local Police Station. After submission of my application he also file an application against me and my parents.He convert civil matter into criminal. He file a Criminal indictment (ISTIGHASA) under section 323, 341,307,384,389 IPC against me and my parents .Rigth now file is in pre cognizance stage. There is not any medical report submitted by that contractor because case is totally false. Even statement given by him in front of magistrate, he only mentioning date of incident take place but not time ,because me and my parents are govt employee, so i want to ask you to that ,is there any option to reject this 'isthagasa" in pre cognizance stage or should I defend in front of magistrate in pre cognizance stage. Because i don't want to mashup in judicial system There is so many evidence that will prove in front of magistrate that we are innocent. Kindly tell me any positive solution or best solution for resolving this problem.
