one of my friend is accused in a cheating and forgery case u/s 420,463,467 &119B. All other accused went under judicial custody whereas he got bail anti-cipatory and subsequently proper bail paying the due amount to the complaining institution from the court.
The case has been running for more than 6 years and so far police have not file chargesheet only against him. Now the lawyer of other accused are asking for plea bargain only on monetary basis. my questions are:
Is is mandatory for her charge sheet.to be filed before plea bargain.
Can a person not undergone judiucial custody would be subjected to harsher penalty of penalty and jail term also.
