I am working in Green Field project and we have taken approval for construction under BOCW act . But I want to know that when we need to apply for plan approval for our factory . please advice . this is new unit and covered under BOCW act .

It is construction for factory -it is not applicable to that go through the BOCW Act-1996.
Most of the cases belong to the BOCW Act-1996 pending in the high court not resolved till now.
All the comapnies construction for factory they are taking stay from the concerened high court.
It is for building/ Villas/Comercial complex they will take a permission with in a period of 60 days for such commencement.(bocw act-1996)
Some Definitions.
While going through the Section 2(d) the definition of buildings or other construction work does not include any building or other construction work to which the provisions of Factories Act 1948 (63 of 1948), or the Mines Act, 1952 (35 of 1952), apply.
You need not register under bocw act-1996 if you will register you will pay 1% cess on the cost of the construction.
First you will take plan aproval of the factory from director of factoires(under factories act-1948) not bocw act-1996.
You will go consult the concerened ACL/DCL/JCL they will give good advise to you.
