hello,
in case of a partition suit betwee three brothers in for a ancestral property, one of the brother who is enjoying all the property and has got some construction put on it.
after the preliminary decree is won,how does the court appointed commisionter go with giving the share in the above case. will he recommed for demolition of the building once a share is alloted and esp if the building with land share overlaps.

Share in land,building may be claimed as equal.
However the person that has built the building alone can stake claim on expense incurred on it.
All points in the suit may be contested and let the clear decision be given by court.
