Partition of ancestral landed property

sir,

we have some anchestral property both landed and housing, some properties are in the name of my grand father and others are in the name of my father and his brother ( uncle). we want to make partition of these lands.

will we have mutual verbal partition or partition in the form of affidavit or registered partition.

as the registered partition  deed require huge money which we can not afford,

whether  the partition in the form of affidavit is legal and stand by the law ?

please give the  suitable comments in the context of Orissa land reforms act

thanks

sanjay

An unregistered partition deed will do and is sufficient to meet your requirements. Law recognizes even an unwritten partition done in the presence of witnesses.
