Pagdi room - non use for 6 months

Dear Sir,

My mother bought a room on pagdi in 1988 from a landlord in Maharashtra and resided there till 2002, post which she had to move to her mother's place to take care of her ill-health. The said pagdi room is presently not in use since 2005 with no electricity at the premises. Also, there was a 2 month delay in rent payment during one of the years (2008). The landlord did not accept the rent along with penalty which we were ready to pay in 2nd month of 2009 and after this the rent is being deposited in the court. The landlord filed a suit in 2010 asking us to relinquish our right to the premises since it is not being used to more than 6 months. Please advice if such a demand is legal (non use for more than 6 months), also the landlord does not want to give us any consideration against our relinquishing the rights to the said premises. We have approached a lawyer and the hearing starts in december.
