I live in Mumbai under a pagdi system. Decades back, the builder had built additional flats above our two floors by erecting pillars. These flats were fully sold to owners who then formed a society. We continued to live under the pagdi system.
Recently (after decades) the society members have started telling us that we are not allowed to use the building's parking areas since we are not members of the society. Note that we have been parking from many years, and also that we have been here since before the society was created.
What are our rights in this case? Do the society members have a right to force us out of our parking spaces? If not, what legal recourse can we take?
