Ownership of road

HI all

This is regarding area development. one person was having 8 Acers of land he sold land in small plots with road connectivity and drainage passages( 30 years Back).People who purchased the land constructed houses colony is being developed. Now grand sons of that person are saying that we have not sold all 8 acers of land and the roads used by the people of the colony belongs to us. Now  grand sons are asking for money for using the roads.

Hi,

As you have mentioned that so called one person sold the property of 8 acres along with area for the road  and drainage. We have to see whether in that Sale deed is it mentioned properly about the same.

If the area for the road is mentioned in the Sale deed thoroughly along with the total plot area for road, its dimensions and demarkations, then the seller's grand sons or anyone else should not have any claim over it. And if it is not mentioned in the said Sale deed, then we have to see on what basis the plan of the building was sanctioned by the Municipal Authorities.

Was that just on the basis of easementary rights or just an NOC from that land owner? See whether the said grandsons are asking for their right over the same just to create nuisance or to get money from you.

HI

This is a Panchayat area no area development plan is there and noting is mentioned in the sale deed. but when the plots were sold roads were there and few years back PWD department metelled the roads.
