Online shopping fraud

My sister has made a prepaid order on an online shopping portal which is not popular. Even after 2.5 months of the order, the item has never been shipped and the number provided on website is never being attended. I got hold of that guy on WhatsApp and he assured that refund will be processed but again 10 days gone. Now he is not entertaining me and stopped giving replies. Should I proceed with normal complaint or it comes under cyber crime? Also want to take it up with consumer forum. Please advise.

Is the establishment registered?

Has IT provided any address on website?

Check ROC website..

Approach your own very able senior  LOCAL counsel of unshakable repute and integrity specializing in Consumer matters  and well versed with latest citations, LOCAL applicable rules/laws/ … and having successful track record…. and worth his/her salt…..and show the case related docs etc etc

Check at LOCAL consumer courts for such counsels..
