Offer droped becoz of not willing to relocate to other than

Dear Sir\Madam,
I had got an offer of employement from capgemini india with base location as Mumbai on 20 May 2014, so put my resignation in current organisation and serving the notice period. suddenly one day in mid of Jun 2014 HR called me to relocate to Hyderabad stating that project had moved to Hyderabad so you have to relocate to Hyderabad. I begged her stating about my sick parents condition and family reasons I cannot move to Hyderabad,but she threatened to me that she will withdraw an offer and told me rollback my resignation in current organization. Before giving me an offer she has not intimated me about the relocation. suddenly on 17 june 2014 she called on 5.25 that she has given enough time to think, within half an hour u have to send mail stating that I will be going to banglore, I argued with her on phone but she did not listen to me and sent an mail of dropping an offer. this is injustice happened to me because of offer I resigned , now I have many liabilities on me as I am family person , entire responsibilities are there which can not be served being a jobless , Can anybody help me to file the complaint against the company.

Did you record the calls?

Approach your Labor consultant/service lawyer AS AP and issue a legal notice.

If your notice period has not ended/resignation has not been accepted in current company, withdraw the notice of resignation without any delay, in writing under proper acknowledgment.

Firm up another employment too AS AP.

Don’t waste time…………….and act fast…………………and defend your interest in the best possible manner.

 

Are you a member of any employee’s unions, trade unions.

Dear Sir,

No I did not recorded any call, also  I am not member of  employee’s unions, trade unions. since this is an IT company , which do not promote to have unions.

But while reading the offer letter yesterday there was clause , so does it indicates the upon acceptance of the offer I had agreed to the below clause.

"Regardless of any secondment to any other company entitles or where you may required to work overseas for any such company entities for an extensive period, you shall at all times remains an employee of the company exclusively and shall not be entitled to any such foreign salary of benefits"

"Governing   Law: The terms and conditions as stipulated above shall be interpreted in accordance with Laws of India. In the event of any dispute , the parties shall submit to the exclusive jurisdiction of the courts of India"

You may take 3 steps suggested.

IT/ITeS employees have formed unions and they have done good job too.

Trade Unions have embraced employees.

Why should your company promote union?

Employee has to take steps to defend his interest and rights.
