Occupancy certificate for 2007 permitted layout in hyderabad

Recently we bought a flat in 4th floor. The build layout got permission in 2007 itself. We got loan from ICICI bank also. As recently GHMC made the occupancy certificate as mandatory, we asked our builder to provide it. He said that since the layout got permission in 2007 itself, this building didn't went for mortgage process and we won't get it. We checked with bank also and they are also telling the same.

Moreover, the building has permission for 4 floors only. But it is constructed with 5 floors. We are not sure about whether we will get the occupancy certificate or not.

Please advice.

surely you will not get occupancy certificate. You ask builder to give building construction permission certificate from GHMC. Lay out permission is different and occupancy certificate is different and construction permission certificate is different. If builder gets building construction certificates, then only occupancy certificate will be issued by GHMC.

"surely you will not get occupancy certificate." is it because of our building has one additional floor for which permission is not there? My builder will have construction permission certificate. If it's there, can we get occupancy certificate?
