Non receipt of consideration of property sale

I sold a plot 3 months back. A part of the consideration amounting to Rs. 4 lakhs which was in the form of a draft was not handed over to me at the time of registration by the buyer. This came to my notice only after 2 months when I did not see the entry in any of my bank accounts. When I contacted the bank in which the buyer purchased the draft, I found that the buyer has encashed it. I have this information in writing from the bank. The details of the draft have been entered in the sale deed. The buyer is refusing give back amount, challenging me get the registration cancelled. What is the solution and conquenses the buyer has to face.

You can send a legal notice first, then file a petition in consumer courts for recovery of money of the draft with interest.
