Non Occupancy Charges

apart from 10 per cent of maintenance charges for NOC, our society is also charging extra money as other income. They say it has been passed in AGM.
Is it acceptable!

Non-occupancy charges can be levied @10% of the maintenance charges excluding Municipal taxes. Any extra charges, even if passed at AGM, are illegal.
