Need advice on accident case

I just started my car at cross road and one bike rider came from left side to take u turn. He hit my car and fall down. He damaged my car from front. He was driving with his mother and fall down. Actually he did mistake by coming from wrong side to take u turn but even though he booked the complaint against me under section IPC 337.

When I tried to explain this case to sub inspector or police inspector, they did not listern to me. They told that when big vehicle and small vehicle having accident, the fault always will be by big vehicle even though it is small vehicle's mistake. Does it correct?

They did not take my statement yet. Do i need to force them and give my statement?

Do i need to do cross FIR against bike rider and does the police should accept it?
