Divorce by mutual consent petition has to presented by both parties and not by one of them, your husband cannot move any such petition individually you both have to sign it and present it in the Family Court for adjudication. If you are not ready for divorce your husband cannot seek divorce by mutual consent maximum he can present petition for divorce on any provided ground like cruelty or desertion of 2 years or more. Need not worry he can do nothing without your cooperation in this regard.
