on the day of accident the car was used as passenger vehicle by driver...

If the employee used it other than for a specified purpose without the consent of the owner, the status is in dispute.. We come across such incidents where interstate Goods vehicles allow passengers to travel in cabins. But for third party insurance, I do not think that makes any difference with the insurance companies.
