Motor Accident claims

In a collision between two motorcycles, both the riders were injured. My client was rushed to a hospital immediately as he was in a critical stage. The other rider filed a complaint before a police officer and the FIR has been registered against my client and subsequently the other rider has also now instituted a MCOP proceedings. The negligence was on the part of the other rider actually! My client has spent over RS.5,00,000/ for medical bills. Can my client file a MCOP case with the same FIR filed by the other rider? Whether my client has to implead my client's insurance company as a party to the claim petition? Whether the FIR against my client will have any adverse effect of my client?

Your client can defend the case after filing chargesheet by police in the court.

Thanks sir. But my question is while filing MCOP shall I use that FIR Copy, rough sketch etc in my claim petition?
