Mother deed..is it really so necessary?

Dear Viewers,

Happy 2012...

Iam planning to buy a 30'X40' site in Bangalore.The owner of the land has purchased total of 4080 sqft and they have one sale deed. As Iam going for a bank loan, the bank has asked for original documents as they are funding maximum for the site purchase. The owner is saying that as we are buying only 30% of the land they have, they would not be able to give the original sale deed (what they have made while purchasing) and they would give us a certified copy.

Iam confused now as the bank has got everything ready and they are about to print the DD if we could arrange for the documents. Kindly help me a way out at the earliest.

Normally, when a vendor is selling a portion of land out of his holding would not give original title deed to the purchaser/vendee at the time of registration.  However, you may insist him to show/furnish the original sale deed for verification and scrutiny by the bank officials.

Dear Mr Gopalakrishnan,

Thanks for your reply. The owner is ready to give a certified copy of the mother deed as well as he is ready to come to the bank to verify the original documents.However the bank is not ready to apporve it. They say that they are funding about 80% of the property value and in return they would not have any original documents.

Pls help a way out.

Dear Vishal,

You are availing loan to purchase the part and portion of the land, not whole land , it is suffice to produce the ceritified copy of mother deed for the  banker's perusal and also get  verified the original mother deed, if requires. Immediatly after the registration of your portion of land, the original conveyance deed belongs to your land can be pledged with the banker.

Dear Vishal,

Which Bank it is?  I wonder why they are insisting for mother document.  Try to explain the scenario to the Bank or seek financial assistance from any other bank or a NBFC.
