Mortgaged property in joint name

Hi,

My uncle has mortgaged a flat (in New Delhi)  which is jointly owned by him, another 2 uncles and my father.

This was done many years ago with our consent.

Now as the terms have been not so good with them,we'd like to get the mortagage removed but my uncle is not ready for the same.

Can we take back the property papers by giving a legal notice to bank and my uncle ?

Can the bank refuse to give back the papers?

Please help me with the correct procedure.

Pay and settle full bank loan, automatically bankers will return back your mortgage papers. Without clear the bank loan, bankers will not returned.
