Mental Harassment

Hi I work for a corporate company and I am good performer when it comes to my task.. There is quality team who audits our work and give feedback on the same.. however the problem is they smoke weed and give all negative feedback and degrade all the women present in the team.. We have brought this incident to our management and they happen to do nothing against it. Is there any way we can go legal on them and get justice of everyone..

UYes you can go legal . YOU need to go to Labor court and ask for gender justice as they are deprecating women employees.Or  go to  a civil court and file for declaration that women employees have the right to be treated equally on pAR WITH MEN  for gender justice. and    Permanent injunction to audit team to refraim from   deprecating women employees  henceforth.  Management should have  a clearcut progressive policy towords women employees.        .

Can u mention type of industry, if your industry is exporting or manufacturing and require buyer audits such as Social compliance, CT PAT, SEDEX etc then make a complaint to buyer, they will immediately act. 

else and in alternate, make a complaint before labour court for gender discrimation, send a copy to the women commission, 

further your organisation must have Internal Complaints Committee as per The s*xual harassment of women at workplace (prevention, prohibition and redresal) act 2013, make complaint to said committee, if ICC is not there make complaint before District Magistrate that ICC is not constituted as formation of ICC is mandatory for all organisations having 10+ employees.

You can make a complaint to the employer/higher official of your organisation, if nobody listen make a complaint before police without hesitating.

Catch them smoking weed. Generate irrefutable evidence.

Download Tgt vs performance data. Get signed copies of appraisals and policy/matrix related to appraisal.

Get record of negative feedback.

Catch them degrading women. Generate irrefutable evidence.

Lodge complaint in writing under proper acknowledgment. Narrate previous incidences.

Transact in writing and under proper acknowledgment/POD.

 

Is there any female employees union/ employees union/Grievance rederessal committee/Works committee/IC etc etc or trade unions……….that have embraced employees’ unions..

Elders of your family, colleagues, employee’s union leaders,  retired employee........... can also help and guide you.  

Prefer them that are your own and known and close. 

Then approach local senior counsel of unshakable repute and integrity specializing in concerned field of law ( e.g; labor/service matters as in your case).

 

Then approach lawful authority under expert and careful guidance of persons that are your own and known and close……………..and your local senior counsel.

Thank you so much for your reply.. my only question is how will I get a evidence of them smoking up at work.. everyone knows they smoke up. Until they do a drug test nobody can get a proof... We know what is happening and voiced out the same to management.. no action taken.. i work for BPO sector..

Ideally it is employer's responsibility to ensure that NO-one enters premises with contraband drugs/weed.

Usually security staff/HR are stakeholders.

The employee's may generate irrefutable evidence (audo/visual/witnessed/minuted) and may inform police also.

Let them be caught red handed.

All all female employees married or anyone expecting childbirth!

Dear LCI Querist @ Sangeetha,

Download the evidence of complaints to employer.

BPO sector is not given blanket exemption from law of Republic of India.

Employee can report direct to law enforcement agencies also in case of violation of law  more so consumption of contraband drugs at work place where female are also employed.

Are there any woman employees that are married/preganant/expecting childbirth.
