Members threatening admin of a website

We have a news based website which covers Indian defence and military news. We also allow community discussions on the same topics.

A person has been threatening us with a legal action if, we don't stop people from posting wrong or misinformed information on defence matters, we have told him that people can be ignorant and stupid but it doesn't mean we can stop everyone from commenting but, he keeps sending us e-mails were he says we are allowing such things to continue.

Our forum is private. We would like to know can he take legal action against us and how can we protect ourself.

with the help of a legal advisor, prepare a well drafted and strong DISCLAIMER for your website that should get all your base covered  from these kind of threat and any legal suits going forward.just saying it is a PUBLIC FORUM doesnt help.

if the member still continues to threaten you, have him refer to your DISCLAIMER.

It is not wrong to have website where you call for discussions. They are only opinions of various persons.  It is not a fact.  It is not illegal.  Let him file case, You can defend.  The case will not stand.

Mr. Vinayak you are bound by Intermediately rules and rule 3 clearly states “Due diligence to be observed by intermediary”. Your statements that people are stupid or not knowledgeable can land you in trouble in court.  Please refrain from using such statements and in future make efforts to validate objections on the comments.

 

 

Without looking at your forum rules or website’s TnC or any other click-wrap agreement which might be there as well as the objections raised, it might be detrimental to give any more advice

Disclaimer clause and and terms and conditions will come to your help.  If the threat appears to be intentional and persists despite 'Disclaimer', you may issue legal notice to the caller asking him to refrain or face the legal music.
