Marriage is not consummated

Hi, I'm a Muslim female.. My marriage was held on June 2018 in Chennai. This is a second marriage for my husband, all elders in both of our family convinced me and arranged this marriage, they told lot of other reasons for his unsuccessful first marriage. But on October 2018 I came to know that My husband is having Psychogenic ED, Even his first marriage was miserably ended because of his impotency. So now, is it possible to declare my marriage as "Null and Void" ?

Dont hurry. .  Counselling can help. Few vodka shots can help. Tequila shots can also do the magic.  dont hurry.

I tried to take him to the counseling for past four months, but he is not at all ready and he don't have interest in s*xual life.

Consult some good lawyer who is truly dedicated to provide you the relief. You can get rid of a impotent husband through court or else consult your elders for Khulla as per Muslim practice (but not the Indian law) where you will receive no monetary compensation.

Thanks for the response.. I just want to know few details like, If I want to go through the court, what is the procedure? how many months it will take to get the final judgement?

If you lisetn to the above chutiya you will get into more problems and can do d**k tana d**k tana d**k tana.. its a song from HAKHK.

Marriage requires patience, with a person like the one you have requires more patience than ever.  This one is impotent as per you, next one you will check and d**k? Well its your choice.

 

But your matter cannot be settled through court.  If you omve court.  Only that will happn which I have explained. Dik tana dik tana dik tana.....

Smt. Rabiya,

Catch hold of some advocate and file divorce based on the above grounds.  Court will register case, from notice till first hearing it will be 1 years time.  Then comes the part where case wont move at all. Somehow or other both advocates will drag matter to lengthen the trial.  Plus it is impossibe to prove that your husband is d**kless or suffers from ED.  Ultimately your divorce case will be dismissed after 6-7 years.  Hopes will now set on High Court, there again 6 years gone.  Matter refer back to lower court again case start from a, b, c, d...

So you better get divorce through your elders and religion via maulvi.  If that is not possible find some other way out, find someone else, go in for live-in relationship and force your husband to file divorce.  When he files divorce, just agree to it without making any alimony claims.

This is the only way, (in your case) one can get divorce.  Based on what story you told here.

Free legal advice and legal aid cell

Under Section 2 (v) of the Dissolution of Muslim Marriage Act, 1939 you can get divorce on the ground of his impotency by filing petition in Family Court, where you reside.  You can approach the District Legal Services Authority in District Court and you will get a free legal aid advocate to help you.  Everything will be provided free of cost.  It will take two to  three years to get divorce from family court.  In the court a direction will be given to husband to appear before a medical board of the government hospital and get potency certificate.  If he fails to get such certificate or fails to appear before such board, adverse inference can be drawn and you would get divorce.  

In Sharia law also, you can go for Khulla and get divorce, as muslim marriage is a contractual marriage and it can be resciended at the will of any one of the parties.  Contact Maulvi of your area Masjid and he will issue notice to your husband and after that marriage will be annuled.
