Maintenance for son

Dear All,

Request to answer the below query.

Husband got divorce in the year 1996.

Sons and Wife opted for Maintenance and that case was unattended and maintenance not granted till date and that MC was not followed upon.

Court ordered for maintenance in the year 1993. Elder son age is 19 and younger son age is 10 years when opted for maintenance.

Husband (he has no one) is due to get his pension arrears from the year 2008 (retirement year) till date.

At this instance, can the sons together or individually file a case for maintenance as they were minors when court ordered maintance for the years when they were minors.

Thanks

SB

Time barred, but any chance to proceed now.

Actually, on 22-07-2008, a legal notice was sent to husband regd maintenance, which was not answered. After that again, nothing was done. This was done in between, so can anything be done now.

What can be done when a legal notice is not answered by other party?

1) It is their look out to answer or rebut the points lest they lose an opportunity, which they may avail later to respond suit their convenience.

2) U can proceed further next step.
