Mahada property in wrong name--- need clarification

Hi,

I have a query with regards to Mahada property.

My husband had purchased his father's house in a chawl and the new papers were made and the house was in my husbands name. One year later the father died. Now 6 months back the chawl was broken down and a builder alloted Mahada flats in the same place. My husband reside abroad and was not present at this time. My husbands mother has got the flat in her name and while the trasfer was done they have shown the old house paper which stated that the house belonged to the father and not the new paper wherein my husband was the owner. Can my husband now get the flat tranfered in his name now???? My husband has 2 elder brothers, can you explain my husband's legal position with regards to this property.
