My question is :
The motor cycle belongs to the son, y, his father x met with an accident while he was riding the motorcycle.. X filed a MVC case against his son y and against the insurance co., On the date of accident motor cycle had got valid comprehensive police.
Insurance co., defense is that x is not a third party. Hence he is not entitled to claim the compensation from the insurance co.,
Kindly let me know is there any ruling that x is third party and entitle to claim the compensation from the ins., c.o.,
