Booking or possession as criteria for assessing Long term capital gain

Dear Experts, 

Here is the context: 

2009: Bought property at Faridabad (Haryana) 

2013: Possession offered by Builder  

2013: Possession not taken due to disaggrement with builder on final payout amount. Filed the consumer court case.Court stayed the proceedings.

2017: Court stay continues and  Talks with Builder to settle the issue based on court instructions.  

 

Q. What if possession/Registration is done in 2017 and property will also be sold in 2017 itself? Does this attract short term capital gain ?
