The first stage will be a pre-court action warning letter, warning that the court will start in 14 days if the debt has not been cleared in that time. If the 14 days do pass with no payment, the lender is within their rights to start a court order to recover their debts.

Irrespective of the laid down process through court and other possession procedures, the guarantor is equally liable and as of now you can not borrow single rupee from any financial institution and may have to even face criminal action in case of misuse.

The simple reply is Banks are having a laid down procedure for recovery process as expeditiously as possible.

Contact a local advocate and get his guidance.
