Rejecting the argument of the man, a Mumbaikar, that only a legally wedded wife can claim maintenance under the Hindu Marriage Act, a bench headed by Justice Vikramajit Sen upheld the Bombay High Court's order allowing her to move before the appropriate forum to claim maintenance.

The legal battle of a woman for nearly two decades finally bore fruit, when theSupreme Court on Tuesday came to her rescue and held that she could claim maintenance from her estranged live-in partner, who is already a married man.

CPC / HMA / HAMA / CrPC / IPC do not even contain this word !!

here, the woman had filed HMP and asked maint. for herself + daughter

trial court gave maint. to daughter only

she filed appeal in HC and then SC

both the courts have held that - she is NOT entitled to maint. under hindu marriage act.

so they have directed her to approach appropriate forum.

 

now she has to approach appropriate forum (PWDVA)

then the case will be decided on merits.

 

most of the ppl. are getting confused because of the heading of this news.

 

SC says : 

live-in partner can CLAIM.

 

GETTING / NOT is a matter of TRIAL under PWDV act.

 

so, i dont find any NEW law-point here ... the same thing is already told several times by SC.
