Legal notice to govt. servant breach service rules

 

There is a govt employee who has taken loan from two financial institutions including ours and now we want to make him liable for the wrong he did, as he stated in affidavit that he has not taken any loan from anywhere, so plese guide what is the procedure , if we want to make him liable for disciplinary action.,and what are the clauses/rules/act on which we can sue or take action.

pls describe major penalty proceeding.

Dear Seemaji.

This is definitely an offence of forgery and submitting false information. You can immediately write to his employer giving details of this conduct. It is against the CCS(conduct) rules. He can be punished under CCS(CCA) Rules, if the person is covered under those rules. Rule 14 of the CCS(CCA) rules provided procedure for conducting inquiry against a govt servant for imposing major penalty which may include even removal/termination from service. You can also file a criminal complaint with the police as the offence is criminal offence under IPC.
