Legal heirs

Hi,

My father expired in Year 2013, and he could not made a will. There was a house owned by my father which was self made.

Currently my married brother is staying in that house with his family.

I want to know as per the law who all would be considered the legal heirs of my father's flat apart from myself and my brother.

My brother is asking for a NOC for the flat to get the flat transferred in his name and for that he had got some NOC document from the GDA (The flat is in Indirapuram, Ghaziabad).

I had already given an NOC last year and based on that NOC they had deposited the house tax but now they are saying to pay water / sewage tax they need another NOC as the water/sewage tax body comes under GDA whereas the house tax collection body is Nagar Nigam.

I am very much confused and want to know why i need to sign NOC again.

if your mother is alive then she is also entitled to 1/3rd share along with you both.with an noc i think its not possible to relinguish your rights in the property he might have got noc to obtain patta on his name
