Legal heir non co-operation

Hi Experts,


My father died on Aug 2017 and there are 3 legal heirs, 2 sons and wife.

He was doing business and incurred lot of debts through promisory notes. The debts are more

than the property left by him (both movable and non-movable). All the property are self earned and not inherited. Promisory notes are not linked to any property and all are written with date and amount.

1. My brother is not co-operating in getting the legal heir certificate and also further on

his intention is not to sign any documents for selling the property to repay the debts.

He dont want to give away his share even though the debts are more than the complete property left by my father.

Can you guide the possible ways to get my brother involved and settle the debts. properties are in tamilnadu.
