Last month salary refusal.

Sir,

I worked in software company through contract as a manager. AFter 2 months clinets has downsized the team, so company relieved me. As per the contract between me and vendor, once i relieved from company, they(Consultant) have to keep in on bench and pay salary until i get a job. But consultant say's in the next day, you are terminated.

I worked full month and asked the salary, they said settlement will happen after 60 days. But 5 months completed still they were not settled my salary and not responding my mail. I check with the company, invoice was cleared. 

How to get my salary and my pf money. What is the legal action i have to take. 

My work place : Bangalore  Head office : Kolkatta

Date of releaved 4th Nov 16.

What is the further action i have to take for getting my last month salary . 

Please guide me in this regard.

Are you terminated by a written termination order?

Is this contract in writing and signed by both parties?

Are you a member of IT/ITeS employee's unions/Trade Unions?

- No its not written any were for termination.

- Yes, its signed by two parties.

- No, i'm not in any union.

- I have an evidence mail, that infosys paid 100% to consultant, but consultant paid only 14 days salary, remaining they were not paid. I sent many mails, but no response.

You should become member of IT/ITeS employee's unions/Trade Unions.

The unions have done a good job in Karnataka, for its members.

They can help you.

As already suggested in other threads:

Involve IT/ITeS employees union, employees unions, trade unions and your matter may get resolved.

You may approach: Inspector appointed under Karnataka Shops & Estbs Act, Payment of Wages Act.

Higher Officials in Dept. of Labor Karnataka.

Greivance Redressal Committee as notifed in Karnataka.

 

If you are unable to reslve on your own or with help aproach an able counsel specializing in labor-service matters.

While you start writing don't forgte to write that you were verbally terminated with immediate effect on dated..............by Mr/Ms.............
