Landlady inciting the tenant to create improglio

The tenant (a shopkeeper) has obtained a stay against the landlady against any illegal evacuation of the shop. Thereafter the landlady frequently barges in the shop and creates quarrels. The intention is to create scene and file frivolous molestation complaints against the shopkeeper to pressurize him to vacate the shop. The landlady earlier tried to file such complaints but the Police did not find any substance in the same. However, she succeeded in pressurizing the Police for a complaint u/s 323, 341 and also a subsequent chargesheet against the poor shopkeeper!

On Deepawali when the entire markets were closed she removed the name of the shopkeeper and painted his shop white.

The Police does not listen to the shopkeeper and expresses helplessness to do anything against the lady.

 

What is the remedy with the poor shopkeeper?

Dear,

 

Tell the shop keeper to write the formal complaint against the land lady and other officials (if any) to the Assistant commissioner of police and other senior officials.

Can the shopkeeper also approach the Court for seeking suitable directions to the Police?

1.  Instal C.C.T.V. in the shop and one around the shop.

2. When she enters the shop, record her conversation.

3. File a complaint against her for filing false complaints against the shopkeeper.

4. File an application before the Court seeking permanent injunction to enter the premises along with interim injunctin under order 39 Rule 1&2 with support documents.
