Respected Sir/Madame,
My grandfather had a property(Grama Natham - real estate of 69 widdth - 105 Length).
He had constructed a house up to (15 Width - 50 Length)
He has Three daughters and three sons. 3 sisters got married before 1980's.
My dad(age 69) is second son to him. Grandpa died in 1988.
My dad signed a 'release - deed' in the year 1966 (age 19) in angry feeling, since they resist to spend money for his higher studies. statement goes like this, "no blood relation to family members" like something. still i dont know what are the exact words. But he didnt signed for any exchanges. Just want to get out of his house, so he did that.
But now Natham - Patta got in all their names (3 sons - in 1996). Property not partitioned yet. My uncle (younger brother to my dad) hide this for more than ten years, since my dad been out of village for past twenty years. Anyhow we managed to got this news(patta in dad name). My uncle, now saying, though patta get in to my dad's name, he cannot claim this since he signed the 'release deed' and he constructed new house in our place( if its get partitioned, it would be our place) and he threating us if we made any claims.
So my questions are,
1. whether My dad/myself can claim rights in that property?
2. My aunt(3 daughters) have rights on this property?
3. What would be the legal advice/options in order to claim rights in that property, for us?
NOTE: As far as release deed concerned - its entered in normal mode, doesn't have any stamp duty but contain register office seal. Still i am not sure, whether its registered or not.
