Is requisite either through registery or nazarat( court)

In tile suit is it mandatory to file requisite of notice through court and post simultaneaously necessary ???..what are the procedure if filed by only one means..

In any suit normally, for the firtst time,  the court will order through court and R.P.A.D.  If it is not served,  the plaintiff/petitioner can request the court to order for Speed Post or for personal notice for better service of summons/notices.  Sometime the defendant/respondent tries to evade service of notice to harass the plaintiff/petitioner, then in that case, if personal notice is ordered by the court, the plaintiff himself accompanied with the court process server can go to the work place or his residence directly and can serve the summons on the spot.  

 

Ordering summons and the way of service is not in our hands, the judge has to decide, we can only request the court to order the summons in a particular way. The discretion will depend upon the court. Normal procedure adopted by the Judge is through court and R.P.A.D.

Gernerally the practice in most of the lower courts of  the country  the notice are served by registered post as well as by Nazarat of the court at the very initial state of filing of Suit..
