Need ur legal Suggestion
My father own a commercial building (300 Sqft Shop + 600 Sqft Goodown) in suburb Chennai (TN) which is Leased out on 2010 for Rs. 4 Lak to a Autu Mech Shed(A lease agreement Created for 3 Yrs not registered).
Again in 2011 My father asked him another 2 Lak as additional lease (Its high demand location) and it totals to 6 Lak.
The lesee Cleverly wrote another lease agreement (For 3 yrs) of Total 6 Lak and included a clause of my father (landlord) paying him a 1% interest on 6 Lak every month (Rs.6000 per month) in which my father signed too (He was in urgency of getting money)
My Father never paid any interest to him and he passed away on Jul 2013.
Now,
I want to Evict him as soon as possible
Just because my father signed the agreement is it legally binding to pay Interest for lease amount from landlord to leese?
Can i contest him on ground that no interest can be collected from land lord?
The Goodown is in damaged state, I wanna reconstruct it and thr is proposal for TN govt to widen the road very soon.
How do i Evect Him with/without legal battle?
