Interim arrears in dv case, can sessions court issue warrant

Namaste Respected Sir,

In DV case, the trial court had rejected the petitioner's application for Warrant in lie non payment of regular interim maintenance. Petitoner has appealed in Sesssions court and now asking sessions court to issues the Warrant.

1. Can Sesssions court issues warrant

2. is there any favorable precedents from APEX court for respondent.

No, session court will not interfere. Compalinant need to file execution petiton for recovery of arrears.

)ONLy !st class  JDFC can issue warrant and SESSions court has no jurisdiction to issue warrant.Nowthe estranged wife should file execution petition to recover arrears.
