Interest liablity

One of my client received supply order from Government Deptt during the year 2006-07 and supplied the goods accordingly against form D on interstate movements of goods, but as form D was abolised from 01-04-07 , assessing officer rejected form D and assessed tax at full rate alonwith interest. Govt Dept pays balance tax but not the interest now wheather there is any case law to waive the un due interest liablity.

In your case it is stated that you have obtained a supply order during the year 2006-07 and sold goods  to Govt Departrment against D form. The aspect whether interstate sales were completed on or before 31-03-07 or not? If completed D form can be used as per notification dtd 29-3-07.
