Hi,
In a business (CAD model job) between two companies, company A provides design(CAD Model) services to its client company B.The component is a plastic medical device,competitor models are already available in the market for the last several years.
No IP clause is mentioned in the purchase order issued by company B to company A and no IP clause is mentioned in the invoice given by company A to company B .Non disclosure agreement is not executed.
If company B try to trouble its service provider A with a threat of breach of non disclosure, will the case stands in the court / arbitration?
If so within how many years from the date of purchase order , company B can file a breach of NDA case againts company A.
