Illegal termination

If an workman is terminated illegally without principal of natural justice. following explanation of unfair labor pratice given in Industrial dispute act fits to the case. (f) in utter disregard of the principles of natural justice in the conduct of domestic enquiry or with undue haste; (g) for misconduct of a minor technical character, without having any regard to the nature of the particular misconduct or the past record or service of the workman, thereby leading to a disproportionate punishment. In that case under which section of industrial dispute act, complaint to be made to labor court. I gone through Industrial dispute act but did not find appropriate section. Is there any other act or rule also applicable? Please help. Thank You.

Here, employee was terminated on vague and false charges on domestic enquiry without giving any opportunity to employee. charges are very nominal that which is silly mistake. real reason for this was complaint by employee to top management about superior.

why is noone answering? this is really strange. whether I have asked something which can be answered only by senior lawyer or people are not able to see this post.
