please advice, i along with a friend bought a residential property in gurgaon (Delhi-NCR) about 1.6 years back, the documents are all in order & there was even a bank loan on it from the seller at that time. now since last few months the wife of the deceased first owner has illegally occupied it and is claiming her right on the property and have filed several police complaints and filed case (s) in GGN Court (complaints mentions that her husband sold the same under various influences). she was never a owner / co-owner in the said property. the property exchanged hands 5-6 times before being bought by us.
what are the actions that can be taken against her, can a police complaint be enough to make her vacate the premises. are there time bound process for such matter. do we need the approach the Court for it.
she is an old lady / senior citizen, does the law give relaxation in such case to the illegal occupant.
