Ignorant father now demanding maintenance

Hi,

Long story short: A father who only played biological role in existance of his son. All expenses of son's upbrinigng and education looked after by mother. Now, son is earning handsomly and the same ignorant father making use of senior citizen law to demand maintenance.

Please throguh some light on this law and what are the chances of him (ignorant father) still getting maintenance.

Does this law dictates that only son (and not daughters) to pay maintenance and that too when father has not been loving, cordially and mostly lived his life on his wife's earnings and never looked after of his kids?

Son is worth all only now when he is earning good?

Father has righ to claim maintenance from son. You have right to put up your case before court however I doubt court may consider the same. Appoint good advocate.

Father who has no source of income for his maintenance or property for extracting income out of it can seek maintenance from his children, both son as well daughter included.

Your father who was good for nothing throughout his life, totally dependent on his wife, namely your mother's income for his own maintenance, should not be allowed the privilege of senior citizen however keeping in mind his age and disability to earn at this age, court will allow him minimum amount just enough for his maintenance.

if your father has no sufficient mean to maintain himself and having no source of income, Law permits him to seek maintenance from his childrens ..whosoever gender is...either Daughter or Son.

Maintenance and Welfare of Parents and Senior Citizens Act, 2007 is a legislation enacted in 2007, initiated by Ministry of Social Justice and Empowerment, Government of India.,to provide more effective provision for maintenance and welfare of parents and senior citizens.

Daughters if are married, can get away from paying money to parents, because she has to maintain her husband and children.

Finally it is prime responsibility of sons to take care of parents expenses if they are unable to maintain themselves.

It is also dharma of son to maintain parents in old age according to Hindu Law.
