If not join company

Hi

 

i gave a interview in one company and i got selected there and offer letter issued to me by company HR.

but now i dont want to join company and company phoned me that they will take a illegal action against me because on offer letter there is one clause that if i will not join company then company will take illegal action ot i have to pay one month decided salary.

 

please suggest me what i do.???

Did you accept the offer letter in writing? If NO, decline to accept offer due to this clause!

If yes find another fault and decline to accept the offer!

Avoid collecting offers!

Do not sign acceptance on dotted line without consulting in advance your elders in the family, competent and experienced well wishers, lawyer /law firm.

Usually companies do not do more than making calls, sending letter or legal notice!

 

If you are perturbed by such letters handover the matter to your lawyer.

A fitting reply by your lawyer may put the matter on 'SHUT UP' mode forever.

Think of faults in the offer etc.

 

Liquidated damages are not   necessarily paid on demand. These may have to be actually spent.

 

So far company has not issued any letter, legal notice etc....................If it does approach your lawyer.

as i heard bad feedback of company so on the behalf of that feedback i can ask i will not join. am i right....??
