How to stay in a mumbai hotel without a marriage certificate

We are a couple, we are married and staying together in Kolkata since two years. We have not registered our marriage and do not wish to register it as it is not mandatory in ou
place. Now the problem is, we are travelling to Mumbai next month and will be staying in a hotel for one day. The hotel person clearly told us that we need to prove marriage to stay
together in the Hotel.
So what alternative we have in this case. Can we together sign an affidavit before notary stating that we are a married couple. We are operating joint bank account since two years and we have a rental deed.
Kindly Guide.

In ID proofs say Aadhar Card it is mentioned Mrs....................W/o.............

Ask the hotel in advance if that is acceptable to them.

What is legal dispute for forming an opinion and advise?

Unfit query.

In Mumbai unless until you have a marriage certificate or atleast you look like decent couple, it is difficult to get room on rent on hourly basis or daily basis.

The Hotel can insist on production of Identity proof,  not any proof or certificate of maariage.

Yes, we have our Passport, Aadhar Card with us.

Meanwhile, we are thinking of filing a joint declaration of marriage before a Judicial Magistrate to solve this problem. Do you think it will solve our problem.

The Hotel is still insisting on production of marriage certificate citing local rule in Mumbai. I don't understand what kind of rule is this as marriage registration is still not mandatory in all the parts of India.

Sir, this is really a big legal problem because every hotel in Mumbai is insisting on Marriage Certificate citing local rule. Thanks.

Sir, for your kind information we are living with dignity and the marriage registration is still not mandatory in various parts of the country.

People should really keep their personal opinions out! Sorry, Dr. Kumar. The website is still growing though unfortunately majority of it is still occupied by chauvinistic, old men of typically patriarchal mind sets.

There cannot be any such rule. Such a rule, if there is any in the Statute Book, would be ultra vires of the Constitution and the rights guaranteed therein.

If you dont get room. You sleep somewhere else.  Railway station, footpath.  Lot of places in India when you dont get room or cannot afford room.

You are simply discussing something which is not worth discussing.

India is a backward country, in thought.  We go by cultures, customs and traditoins even today.  Even courts agree with it.

There is unspoken law of land which is called custom.

If a hotel is not obliging to give room to you and your wife who is seen as a prostitute or keep by the hotel, then you cant do anything.

In India if you file case against hotel, that will only consume money and time, and lot of headache for you both.

Recently I came across one couple who were denied a room, maybe that person is you, youtube has that video, the couple threatens to go to human rights etc.  All that is useless.

There is a particular look of a married couple.  If you dont have that look even police will doubt you, if you are holding hands in public.

Whether members in the forum are forward thinking or bakward thinking has nothing to do with my views.  Point is you did not get a room, because hotel did not feel you were husband and wife.

To prove that if you give marriage certificate, it will look ridiculous (given that you are stating that you are married).

You cant change the world and your issue is a pathetic one. Sorry to say this.  You dont seem to have any work, you are simply continuing to discuss a topic which was discussed for days on national tv, ultimately hotel owners have right to decide whom to rent a room or not.  Period.

My advice:

Go to some decent hotel.  Not to those cheap hotels where prostitute takes their customers.  More importantly behave decently. Hope this helps.

You can write to the said hotel to forwats you the said local rule and also ask if the said affidavit and your valid photo  ID proof's showing  Mrs...................W/o ...Mr............is acceptable to them.

If the Hotel is member of Hotel Association, that it might be, check with the officials..............

I could recommend you to try Stay Uncle or OYO rooms. (Which would help you shortlist hotels in Mumbai for stay of unmarried couples.)

If hotel owner does not want to rent you a room, you should take next hotel.  That is common sense.  WHich seems to be missing.

What is the real problem Dr. Kumar? You want the hotels to change their rules or simply you want an accommodation? One crooked idea is there. Being a doctor, hope you can surely afford,  take two rooms next to each other and later on can sneak in. No one questions in a star hotel. Or stay put in relatives or friends house. If no friends try some one from Facebook. Good luck. Finding it funny that you are asking a solution for a day's stay  in Mumbai hotel to people who have nonchalantly slept inside jails because of of our wives. Let us wind up. Leave the doctor alone.
