How to register a marriage under hma ?

Respected members,

My brother will be getting married this coming month.  I want to know the following details :-

1.  Who is the authority that registers marriage under Hindu Marriage Act ?

2.  Does marriage have to be registered in place where marriage is solominised or it does't matter ?

3.  Does the state where the marriage is registered matter in the long run for eg. facilities, government schemes , or is it a centralised process?

Thanking You

Hindu marriage registration can be done either under the Hindu Marriage Act,1955 for which contact the Hindu Marriage Registrar of your district, usually the Tehsildar or SDM is holding the powers of registrar of Hindu marriages.

The marriages in the city in many states are also done by the Muncipal Corporation of the city where you live and your marriage is solemnised. Contact the Marriage Registrar in your Muncipal Corporation Office for the registration process.

No centralised marriage registration but only statewise provisions in India.

Some state governments permit them in temples, and empowered them to issue such bonafide certificates.  Marriages in Arya Samaj are also valid.  In some states a Sub-Registrar , marriages (same Registration dept , with additional responsibility) gives such certificate.  The minimum documents required are age proof, marriage hall certificate, minimum two witnesses, three photographs of Exchanging garlands, Sootra Dharan, Saptapadi or Rituals before fire and a wedding card if available).

Generally the Registrar of marriages where the marriage actually has taken  place issues certificate and even after marriage such certifiate can be secured within a day, if all documents are filed with such application.

The marriage can be registered at the sub-registrar's office having territorial jurisdiction. The marriage can be registered directly at the regitrar's office. It can also be registered after a customary Hindu marriage. Sometimes the registrar goes to the marriage venue and registers it.

The Hindu Marriage Act is applicable in cases where both husband and wife are Hindus, Buddhists, Jains or Sikhs or where they have converted into any of these religions. The act sets minimum age of marriage for men as 21 years and for women as 18 years.

As per the Hindu Marriage Act, 1955, following are the requirements for registration: One can apply for marriage at any sub-divisional magistrate’s office. The details are required after confirming your district/state. The registration form must be duly signed by both male and female with a sound state of mind. Both the parties must not fall within any degree of prohibited relationship. The second requirement for registration under Hindu Marriage Act, 1955 is any document that provides the date of birth of the individuals. The documents maybe the birth certificate, matriculation certificate, passports, PAN cards, etc. Two passport size photographs of both the parties are required, also one marriage photograph and Marriage invitation card (which although is not mandatory). In a case where the individuals have converted to any of the religions which the Hindu Marriage Act, 1955 covers, the conversion certificate duly verified by a priest to the religion which the individuals have converted to, is also required. The most important process for the registration to complete is the attestation of a Gazetted officer. All the above-mentioned documents must be verified by a Gazetted officer. After the submission of all the above-mentioned documents duly verified, it shall be the duty of the district court to confirm and put a final thumbs up on the marriage registration of the individuals. The basic cost of registration differs from state to state; it is however in between Rs. 100-200. Regards
