How to create the encumberance in register office with will.

I ask this question for the property outside metroploitan area which does not require probate.

 

When the Will is not registered by the original testator.

 

And after the death of the original testator. How to make public know that there is a Will existing in the document.

 

How is it possible to prevent the alienation of the property by other legal heirs.

Hi, dear law student,

A will takes its own course immediately on the death of the executer.  Normally there is the limitation for filing the decleration suit - 3 years from the date of cause of action.

Many person told that it is not necessary to do anything with the will.

They said it is not necessary to do anything with the will.

Just a copy of the will is sufficient.

In such circumstance

Is it Mandatory to file the declaration suit?
