There is no stereotype format for filing a divorce petition, every case has to be drafted as per its own facts. A lawyer needs to know all the details before preparing the case. Discuss in details all the facts with a good lawyer and file the case on the ground of cruelty. Merely filing of 498a or dv case by a wife is no cruelty unless they are proved to be false. So from all the facts it will have to be judged whether the ground of cruelty is made out or not. If your wife is unable to maintain herself then she can claim alimony.
